Does any Haxial program surreptitiously send information to Haxial Software (the company)?

Definitely not. Please see Haxial's Privacy Policy.

Does any Haxial program include any "spyware"?

Definitely not. Spyware is software that collects personal/private information from your computer, and then sends it to the author of the software. Haxial would NEVER invade your privacy like that. Protection of privacy is important to Haxial.

I found the following warning about Haxial/KDX, is it true?

No, it is completely fake. As a joke in poor taste, someone wrote and started circulating this message:

"Beware, the app KDX, available on http://www.haxial.com/, is built on a codebase that mimics virus activity as defined by "Norton Anti-Virus" report generator.

KDX appears to call API's to the FileMan for directory listings that could in no way be relevant to the app. It seems to encrypt these listings to an unallocated disk sector.

Periodically, KDX accesses this disk sector and burstcoms the data to a server on IP# 216.240.147.218 (haxial.com) on port 10500. It uses UDP as the carrier.

We have yet to establish the purpose of this portion of the KDX code, but it does seem suspiciously like other data gathering apps used to build databases for law enforcment agencies.

This warning is completely FAKE. No Haxial program will collect information about you and then surreptitiously send it to Haxial without your permission. Haxial encourages people to verify this for themselves by using a network monitoring tool, and many people have done so and confirmed that no Haxial programs send information to Haxial without your permission. Is it possible that you are using encryption to hide the data being sent?

No. It is true that data can be encrypted, making it unreadable. However that does NOT make it vanish. For example, say you encrypt a 1 megabyte file with any encryption program you download from the Internet. After you have encrypted it, the file is still 1 megabyte in size (or sometimes slightly bigger). The file does not vanish, does it? And the content of the file does not vanish either -- the file is still 1 megabyte, not zero bytes. To further prove the point, look up the word "encrypt" in a dictionary. For example:

encrypt   tr.v.
1. To put into code or cipher.
2. Computer Science. To alter (a file, for example) using a secret code so as to be unintelligible to unauthorized parties.

As you can see, according to the dictionary, there is nothing about hiding the information or making it vanish, rather the dictionary says that the information is ALTERED to make it unintelligible / unreadable.

So how does this apply to KDX? It means that even if KDX used encryption while sending data to Haxial, although you would be unable to read what information was sent, you would still be able to see that SOMETHING was sent to Haxial, and then you would know that KDX was probably spyware. For example, say you write a letter using a secret encryption code you have devised, and then you post the letter to your friend. Postal workers cannot read your letter, but they still KNOW that you sent SOMETHING because they can see your letter, even if they cannot read it.

The fact is that numerous people have tested KDX, and confirmed that it sends absolutely NO data to anywhere other than the servers/trackers/clients that you specifically connected to. Please know that Haxial hates spyware as much as you do.

Is "spyware" illegal?

That depends on the country and state that you live in (your jurisdiction). Some jurisdictions have more strict privacy laws than others. Certainly it is possible that spyware is illegal where you live, but you would have to ask a local lawyer to be sure. In Haxial's opinion, spyware should definitely be illegal -- it is a terrible invasion of privacy.

Is there a "backdoor" in KDX?

Haxial would never intentionally put an undocumented "backdoor" in any of its products. A backdoor is a secret way to gain access to a server, other than via the usual method. If Haxial did this, it would only be a matter of time before some hacker discovered it and shared the information, and people started using it to abuse people's servers, and then Haxial's reputation for creating secure products would be damaged. Haxial would never risk this.

Does any Haxial program send information about me to the CIA / FBI / government organizations? / Do government organizations monitor KDX?

What the hell?! What drugs are you smoking? Or are you just so incredibly gullible that you believe any unsubstantiated and nonsensical rumor that floats past you? We are going to have to beat you senseless now, as punishment for asking such a ridiculous question.
